The judges use of Obama's past rhetoric will haunt the ruling. It was political ad hominem - it did not go to the law or the facts.
Personally, I like our chances with Kennedy. We'll see this year or next. Further, as each day passes, the legislation accrues to the Democrats benefit. Can you imagine an activist court doing for the GOP what they could not do at the ballot box? What will voters do to those who want kids to go without healthcare? What will happen to those that reintroduced coverage prohibitions on pre-existing conditions? How many uninsured Americans will VOTE? It will be watershed moment that the GOP long regrets.
